Judicial Verdicts

The Western Regional Prosecutor’s Office for Human Trafficking, headquartered in Quetzaltenango, successfully prosecuted the case known as “Cárcel y Explotación”. The Specialized Criminal Sentencing Court for Human Trafficking Crimes in Zacapa handed down convictions against two former officials of the General Directorate of the Penitentiary System:

• Bayron M., former Deputy Director of the Mazatenango Preventive Detention Center, received a 13-year and 4-month custodial sentence, a fine of Q133,333.32, and a special disqualification from holding public office, after being found guilty of aggravated promotion, facilitation, or patronage of prostitution involving two female inmates.
• Priscila R., former Warden of the same facility, was sentenced to 21 years and 4 months’ imprisonment, fined Q800,000, and barred from public service, following her conviction for human trafficking in the form of sexual exploitation with aggravating circumstances affecting two incarcerated women.

These sentences reflect judicial findings that the individuals conspired and abused their positions of authority to perpetrate crimes within penitentiary facilities.

Evidence & Investigation

Between June and December 2021, the Public Ministry presented evidence demonstrating that the offenders orchestrated a systematic scheme to exploit incarcerated women sexually. They organized clandestine gatherings—commonly referred to as «vueltas»—within the prison and charged payments ranging from Q300 to Q1,500 per sexual act, thereby profiting from institutional power and violating the rights of detained women.

These findings mirror broader investigations into pervasive corruption and sexual exploitation within Guatemalan prisons, as documented by InSight Crime, which has repeatedly highlighted similar abuse patterns among prison staff across various departments

Reparative Hearing & Victim Redress

A hearing on dignified reparations has been scheduled for Monday, August 4, 2025, at 9:00 AM, before the same specialized court. During this session, the Public Ministry will seek reparative measures and guarantees of non-repetition to support the victims and reinforce preventative safeguards within penitentiary institutions.

By securing convictions of senior prison officials engaged in a coordinated exploitation scheme, Guatemala’s justice system demonstrates a strong stance against institutional abuse and reinforces the protection of vulnerable incarcerated individuals.
