In a press briefing, Mr. Angel Pineda, Secretary General of the Public Ministry; Mr. Estuardo Ávila, Secretary against Corruption; Mr. Mario Véliz, Prosecutor of the Special Prosecutor’s Office against Impunity (FECI); and Mrs. Leonor Morales, Section Prosecutor of the Crimes against Justice Operators and Union Leaders Unit, provided updates on significant developments in the “Semilla Corruption” Case, as well as judicial and constitutional resolutions issued by national courts.

Secretary Pineda emphasized that these results are the outcome of a sustained investigation conducted with technical rigor, strict adherence to legal procedures, and in coordination with justice system institutions.

Prosecutor Morales outlined the case’s background, noting that to date, seven individuals have received convictions through plea agreements, acknowledging explicit culpability based on the evidence presented. Additionally, three persons have been sentenced to custodial penalties, and five others remain under active investigation.

Prosecutor Véliz highlighted that the ongoing proceedings have incorporated new investigative evidence, including audio recordings, which have been subjected to technical and forensic analysis at the National Institute of Forensic Sciences (INACIF). The analysis identified four individuals connected to the case. Investigative actions continue to clarify the circumstances of the offenses while maintaining strict compliance with due process, objectivity, and constitutional guarantees.

Regarding judicial actions, Prosecutor Morales recalled that on July 12, 2023, FECI requested the suspension of the legal personality of the pro-formation committee of the Movimiento Semilla political party, which was authorized by the competent judicial authority under the Criminal Procedure Code, Civil and Commercial Procedure Code, and the Law against Organized Crime. These precautionary measures were subsequently upheld by appellate courts, including the Supreme Court of Justice and the Constitutional Court, remaining firm at all levels of review.

On November 27, 2024, the cancellation of the pro-formation committee and the Movimiento Semilla party was officially authorized and supported by higher judicial bodies. The Supreme Electoral Tribunal dismissed appeals against the cancellation, confirming the legality of the actions taken in compliance with the judicial order, which was duly published in the official gazette. Consequently, the political party Movimiento Semilla no longer exists in legal terms and, in accordance with the Electoral and Political Parties Law, cannot use its name or emblem during the period established by law.

The Constitutional Court also resolved various appeals related to the case, confirming the legality of the decisions and determining that no constitutional rights were violated.

During the briefing, authorities also reported that additional investigations and legal proceedings are ongoing, including pretrial proceedings for offenses such as:

• Use of falsified documents with electoral aggravation and in a continuous manner
• False reporting
• Obstruction of justice
• Disobedience
• Money laundering or asset-related crimes
• Irregularities in the oversight of electoral campaign financing

Investigations are also progressing regarding the potential irregular awarding of the information system contract for the 2023 electoral process, valued at approximately Q148 million, including review of documentation suggesting inconsistencies in the importation of equipment.

Authorities reaffirmed that all actions by the Public Ministry are carried out strictly within their constitutional mandate: to investigate reported offenses, gather evidentiary support, and submit findings to the competent court, upholding legality, truth, and justice.
