Public Ministry (MP) coordinates the apprehensions of nine people in the Chimaltenango Hospital Case

The Anti-Corruption Prosecutor’s Office coordinated with the National Civil Police (PNC) 26 raids, for search, inspection, and seizure of evidence in properties located in the departments of Chimaltenango and Guatemala, as follow-up to an investigation for the possible crime of fraud, concerning the entity «Voltar Intermedia, Sociedad Anónima».

As a result, nine people were apprehended and, as part of the proceedings in Guatemala City, it was also determined that eight of the nine companies raided were fake. In addition, several pieces of evidence were collected to strengthen the ongoing investigation.
The detainees are: Mario Rodolfo Pineda Cifuentes, Carlos Roberto Ovalle Abaj, Ozni Eli Navas Delgado; Luis Estuardo Solórzano Veliz; Marlynn Melissa Marroquín Chalí; Ovidio Morales Ortiz; Carlos Humberto García López; Walter Humberto García Guerra and Pedro Aguilar Sequen (public arrest).

Among the evidence seized were cell phones, various documents, tablets and other items that will strengthen the investigation. For this case, Gerardo David Hernández García, Luisa Fernanda Villagrán Méndez and Gerardo Arturo Fuentes Rubio have been criminally linked to fraud charges.

According to the fiscal thesis, Gerardo David Hernández García in his capacity as Vice-Minister of Public Health and Social Assistance and Gerardo Arturo Fuentes Rubio in his capacity as Director of the Chimaltenango Hospital during the period from December 19 to 30, 2022, they intervened in the phases of request for order, publication of electronic bid, awarding, purchase order, and payment of the purchase processes carried out through the Executing Unit 237 National Chimaltenango Hospital, therefore, consisting of a total of 770 purchases awarded through the modality of Direct Purchase with Electronic Bid, to provide supplies with warranty services to the new National Chimaltenango Hospital, which would be inaugurated in the year 2023.

On account of the aforementioned events, they called to a meeting, the personnel working in the Ministry of Public Health and the National Chimaltenango Hospital, that would have participated in the different phases of the purchase process, and were given orders under pressure to process the necessary documentation, required to award and pay the acquisitions to the entity «Voltar Intermedia Sociedad Anónima», for the amount of Q. 67,737,291.00; not to mention, that the defendant Luisa Fernanda Villagrán Méndez is the legal representative. Thus, the preceding amount was settled, without complying with any of the terms of reference offered, warranty service, overvaluing and failing to comply with the immediate delivery of 580 equipment devices, which were not located in the National Chimaltenango Hospital.
